The Consumer Protection Act 1987 was brought into English law to provide rights and protection to consumers who buy goods and services. This legislation provides protection to individuals who have been injured by a defective product if it can be proved that the product was defective and that it was responsible for the injuries sustained.

What is a defective product?

A defective product is any product that causes injury to a person due to faulty labelling, a design defect or defective manufacturing. This is also commonly known as ‘product liability’.

With cases of this type, the manufacturer of the product is usually liable for any injuries or losses suffered by the consumer. If you have been injured or suffered a loss as a result of a defective product, you may be entitled to claim compensation from the person who manufactured or sold it.

Common Injuries

Injuries sustained as a result of defective products can range from minor rashes as a result of faulty skin care products to serious burns and life-long injuries following allergic reactions to hair dye products. It is important you seek urgent medical attention if you have sustained injury and retain the faulty product.

What to do if you have been injured

To help your case, you should report the dangerous product accident to the person responsible for it as soon as possible, make a note of your accident in the accident book if possible, take names and addresses of witnesses to the accident and if appropriate retain and take photographs of the faulty product itself. You should also keep the original purchase receipt for the dangerous product as it may be required as evidence.

Time Limits

When making a defective product claim, Court proceedings must be issued within 3 years of the date of injury. Failing to make a claim within this time will cause the claim to be ‘statute barred’ or disallowed. If however, you suffered an injury which happened more than 3 years ago, you may still be entitled to make a claim if you found out that the injury was caused by the defective product within the last 3 years.
