The Police Complaint

The police complaint process can be quite complex thus it is beneficial to instruct a specialist solicitor on police conduct. Please note changes are being made to the police complaints system through the Policing and Crime Act 2017.

The purpose of the complaint is to have the particular officer investigated for the conduct complained of. The complaint must be directed to the police force you are complaining about. The force will then allocate your complaint to an officer or to the professional standards department to investigate your complaint. The complaint can be dealt with in two ways;

Local Resolution

This should only be used for less serious complaints. The following actions could be taken;

Local Investigation

This should be used in circumstances when a complaint needs to be investigated thoroughly and would be used for more serious complaints. The investigation should be conducted with the fact the investigation report could be used for criminal proceedings or disciplinary proceedings against the officer complained about. Under the complaints procedure, there are no set time scales however the police force should keep you informed every 28 days.

The purpose of the investigation is to gather all of the evidence available and assess the officers or force conduct in line with the standards of professional behaviour. If the officers’ conduct has fallen below the standards required of him/her then the following may apply;

If you are not satisfied with the outcome of the investigation you are given 28 days to appeal the decision.

The Civil Action Against ThePolice

The civil action against the police is conducted with the sole purpose in obtaining damages (compensation) for mistreatment and an admission of liability. Actions against the police are in most circumstances highly defended thus we strongly advise you to instruct an experienced legal team such as ourselves.

Time Limits

Initial complaints need to be made to the relevant police force within one year of the incident. A claim for personal injury damages needs to made within three years of the incident. Other aspects of your claim such as matters arising under the Human Rights Act must be made within one year and for discrimination complaints, a claim must be made within six months of the incident. Other areas such as malicious prosecution, false imprisonment and misfeasance in public office, a claim must be made within six years.

Role of the Independent Office for Police Conduct (“IOPC”)

The police complaint should always start at the relevant police force however the police force must refer the following to the IOPC;

The IOPC will then decide how the investigation will be conducted whether they will direct the police force to conduct a local investigation or whether the IOPC will manage/supervise the investigation or whether the IOPC will conduct an independent investigation.
